The following terms and conditions apply to the gift promotion:
§1 SUBJECT MATTER
These terms and conditions and privacy policies govern participation in gift promotions offered by buah.de (hereinafter referred to as the organizer) by participants, as well as the use and collection of user-related data. The gift promotion is organized, conducted, and managed by buah GmbH, Seeholzenstraße 2, 82166 Gräfelfing.
§2 PARTICIPATION, DURATION & PROCEDURE
From March 1st to March 31st, 2026 inclusive, all purchases in the buah.de online shop will automatically participate in the gift promotion. Participation is exclusively online via buah.de.
All persons residing in Germany who are at least 18 years old and have accepted these terms and conditions are eligible to participate. Employees of buah GmbH, their relatives, and all persons involved in the conception and implementation of the gift promotion are excluded from participation.
The subject of this gift promotion is the value of the purchase made, including any applicable shipping costs. The full purchase price will be refunded via the selected payment method.
The recipients of the gifts will be selected at random. Three separate selection processes will take place during the promotional period from March 1st to March 31st, 2026. Participants will be notified of their selection via a "Golden Ticket" included with their purchase, which confirms the gift and explains the next steps.
§3 PROCESSING
Upon receiving the “Golden Ticket,” recipients are asked to contact buah.de customer service with a photo of the ticket and the gift code printed on the ticket. The refund process will then be initiated.
If participants who receive a gift do not respond within 14 days of receiving the goods or the Golden Ticket, the gift will be forfeited. Cash payment of the gifted amount, its exchange, or transfer to other persons is not possible. Participants may decline the gift. In this case, another participant will be randomly selected.
§4 WARRANTY DISCLAIMER
The organizer points out that the availability and functionality of the giveaway cannot be guaranteed. The giveaway may be terminated or removed due to external circumstances and constraints, without giving rise to any claims by participants against the organizer.
§5 NOTICES AND CONDITIONS
As part of this giveaway, no information or data beyond what is normally processed through buah.de will be collected. No separate data storage will occur, and participants will not be asked to provide the organizer with any further information. The organizer is committed to handling this data in accordance with generally applicable data protection regulations and will not share it with third parties.
By participating in the competitions, the participant accepts these terms and conditions. The data protection information is part of the terms and conditions and must also be acknowledged by the participant.

General Terms and conditions of participation
§1 SUBJECT MATTER
These terms and conditions and privacy policy govern participation in prize draws by buah.de (hereinafter: the organizer) by the participants as well as the collection and use of data collected or provided by the participants.
By participating in the competition, participants accept these terms and conditions. The eligibility requirements, the participation period, the prizes, and information on how the winners are drawn can be found in the competition description on the competition page.

§2 RIGHTS OF USE, INDEMNIFICATION AND LIABILITY
The organizer is not obligated to review content provided by participants (e.g., images) for potential infringements of third-party rights. However, the organizer is entitled to reject such content if, in their reasonable judgment, it is unlawful or violates accepted standards of decency.
By providing content, especially images, participants declare that the content is free from third-party rights, meaning it either originates from them or they have obtained the consent of the copyright holders and the persons depicted in images and videos.
Participants indemnify the organizer against all third-party claims arising from the content they provide. They agree to support the organizer in defending against such claims in any reasonable manner.
Participants agree that their submissions may be used, distributed, and otherwise made publicly available to third parties by the organizer in connection with the competition, the drawing, processing, and presentation of entries, both online and offline (e.g., in print). For these purposes, the organizer is also permitted to edit the submissions and, if necessary, grant usage rights to third parties. This granting of rights is free of charge and without any geographical, content-related, or temporal restrictions.
§3 PROCESSING
The prize cannot be paid out in cash or in kind, nor can it be exchanged or transferred to other persons. A participant may decline the prize. In this case, the next participant in the prize ranking will take their place. The delivery of the prizes will be arranged individually with the participants.
Participants will be notified of their winnings and asked to confirm their acceptance as soon as possible via email to the specified email address, by post or via direct communication in the respective medium.
If a participant does not confirm acceptance of the prize within two weeks, the prize is forfeited. Should the provided contact information be incorrect (e.g., email addresses), the organizer is not obligated to find the correct addresses. Any disadvantages resulting from providing incorrect contact information are the responsibility of the participant.
§4 WARRANTY DISCLAIMER
The organizer points out that the availability and functionality of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints, without giving rise to any claims by participants against the organizer.
§5 LIABILITY
Notwithstanding any other legal requirements for claims, the following exclusions and limitations of liability apply to the liability of the organizer for damages in accordance with this clause .
The organizer is liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
Furthermore, the organizer is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper execution of the competition and on whose compliance the contractual partners regularly rely. In this case, however, the organizer is only liable for foreseeable damages typical of this type of contract. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The foregoing limitations of liability do not apply in cases of injury to life, body, or health, for defects after the assumption of guarantees regarding the quality of a product, or in cases of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
To the extent that the liability of the organizer is excluded or limited, this also applies to the personal liability of the organizer's employees, representatives and agents.
§6 NOTES AND CONDITIONS
Participants cannot assert any claims against Instagram arising in connection with the use of the sweepstakes application or participation in the sweepstakes.
Participants acknowledge that neither the contest application nor the contest itself is sponsored, endorsed, or organized by Instagram in any way, nor is it affiliated with Instagram.
All information and data provided by participants through the use of the sweepstakes application or during the sweepstakes will only be made available to the organizer.
