Conditions of participation for the gift campaign:

The gift campaign is subject to the following conditions of participation:
§1 SUBJECT
These declarations and data protection statements regulate the participation in gift campaigns from buah.de (hereinafter: the organizer) by the participants, as well as the use and collection of user-related data. The gift campaign is organized, carried out and processed by buah GmbH, Seeholzenstraße 2, 82166 Gräfelfing.
§2 PARTICIPATION, DURATION & PROCEDURE
In the period from October 1st to October 30st, 2024, all purchases in the buah.de online shop automatically participate in the gift promotion. Participation only online via buah.de
All persons residing in Germany who are at least 18 years old and have accepted these terms and conditions are eligible to participate. Employees of buah GmbH and their relatives and all persons involved in the conception and implementation of the gift campaign are excluded from participation.
The gift offer is for the value of the purchase made, including any shipping costs. The purchase amount paid will be refunded in full via the selected payment method.
The recipients of the gifts will be chosen at random. There will be three individual selection processes during the campaign period from October 1st to October 30st, 2024. Participants will be notified of their selection via a “Golden Ticket” enclosed with their purchase, which confirms the gift and explains the further process.
§3 SETTLEMENT
Upon receipt of the “Golden Ticket”, the recipient is asked to contact buah.de’s customer service with a photo of the ticket and the gift code printed on the ticket. The refund process will then be initiated.
If participants who have received a gift do not respond within 14 days of receiving the goods or the Golden Ticket, the gift will expire. The gifted amount cannot be paid out in cash or in kind, exchanged or transferred to another person. Participants can forego the gift. In this case, another participant will be selected at random.
§4 WARRANTY EXCLUSION
The organizer points out that the availability and functionality of the gift campaign cannot be guaranteed. The gift campaign can be terminated or removed due to external circumstances and constraints without this giving rise to any claims by the participants against the organizer.
§5 NOTES AND CONDITIONS
As part of the gift campaign, no information or data beyond the usual sales process will be collected via buah.de. No separate storage takes place and participants are not asked at any point to provide the organizer with further data. The organizer undertakes to handle this data in accordance with the generally applicable data protection regulations and not to pass it on to third parties.
By taking part in the competitions, the participant accepts these conditions of participation. The information on data protection is part of the conditions of participation and must also be accepted by the participant.
All inquiries and information regarding the gift campaign should be directed to the organizer.
Conditions of participation in competitions
§1 SUBJECT
These terms and conditions of participation and data protection information regulate the participation in competitions organized by buah.de (hereinafter: the organizer) by the participants as well as the collection and use of the data collected or communicated by the participants.
By participating in the competition, participants accept these conditions of participation.

§2 RIGHTS OF USE, INDEMNITY AND RESPONSIBILITY
The organizer is not obliged to check the content provided by the participants (e.g. images) for potential violations of the rights of third parties. However, the organizer is entitled to reject them if the content is, in its reasonable opinion, illegal or violates common decency.
By providing content, especially images, participants declare that the content is free of third-party rights, i.e. that it either originates from them or that they have obtained the consent of the authors and the persons depicted in the images and videos.
The participants release the organizer from all claims by third parties that arise due to the content made available to the participants. They agree to support the organizer in every reasonable way in defending against these claims.
Participants agree that their submissions may be used, distributed and otherwise made publicly available to third parties by the organizer in online and offline media (e.g. in print) in connection with the competition, the drawing, processing and presentation of the participants' contributions. For these purposes, the organizer is also permitted to edit the submissions and, if necessary, to grant third parties rights of use to them. This granting of rights is free of charge and without any spatial, content or temporal restrictions.
§3 SETTLEMENT
It is not possible to pay out the prize in cash or in kind, or to exchange or transfer it to another person. A participant can waive the prize. In this case, the next participant in the winners' ranking will take their place. The handover of the prizes will be coordinated individually with the participants.
Participants will be notified of their winnings promptly by email to the email address provided, by post or by direct contact in the respective medium and will be asked to confirm.
If a participant does not confirm acceptance of the prize within a period of 4 weeks, the prize will be forfeited. If the contact details provided are incorrect (e.g. email addresses), the organizer is not obliged to find out the correct addresses. Any disadvantages resulting from providing incorrect contact details are at the participant's expense.
§4 WARRANTY EXCLUSION
The organizer points out that the availability and functionality of the competition cannot be guaranteed. The competition can be terminated or removed due to external circumstances and constraints without this giving rise to any claims by the participants against the organizer.
§5 LIABILITY
The following exclusions and limitations of liability shall apply to the organizer’s liability for damages, without prejudice to the other statutory requirements for claims under this Section 5.
The organizer is liable without limitation if the cause of the damage is based on intent or gross negligence.
Furthermore, the organizer is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which makes the proper conduct of the competition possible in the first place and on whose compliance the contracting parties regularly rely. In this case, however, the organizer is only liable for foreseeable, contract-typical damage. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after the assumption of a guarantee of quality for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
To the extent that the organizer’s liability is excluded or limited, this also applies to the personal liability of the organizer’s employees, representatives and vicarious agents.
§6 NOTES AND CONDITIONS
Participants cannot assert any claims against Instagram arising in connection with the use of the competition application or participation in the competition.
Participants acknowledge that both the competition application and the competition are in no way sponsored, supported or organized by Instagram and have no connection with Instagram.
All information and data communicated or collected by participants through the use of the competition application or during the competition will only be made available to the organizer.
